These Terms of Service ("Terms") govern access to The ForgePeak platform operated by ForgePeak LLC. By creating an account or using the service, you agree to these Terms.

Service description

ForgePeak provides software for financial advisory firms to manage webinar registration, lead pipelines, appointment tracking, and related workflows. The platform is a technology tool — not a registered investment adviser, broker-dealer, or insurance agency.

Advisor responsibilities

• You are solely responsible for compliance with applicable US and Canadian securities, insurance, and privacy laws, including SEC, FINRA, state/provincial regulators, PIPEDA, and CASL.
• You must obtain valid consent before importing contacts or sending marketing communications through the platform.
• You must configure accurate firm disclosures, mailing address, and compliance contact information in Settings.
• Educational content and disclaimers on your public pages remain your responsibility.

Founding period access

During the founding partner period, access may be provided at no charge. We may introduce paid plans with advance notice. Features and pricing may change as the product matures.

Data ownership

You retain ownership of your firm data and prospect records. You grant ForgePeak a limited license to host, process, and transmit that data to provide the service.

Acceptable use

You may not use ForgePeak to send unlawful communications, misrepresent products or performance, bypass consent requirements, or upload data you are not authorized to process.

Disclaimer of warranties

The service is provided "as is." We do not guarantee regulatory approval, specific business outcomes, or uninterrupted operation.

Limitation of liability

To the maximum extent permitted by law, ForgePeak LLC is not liable for indirect, incidental, or consequential damages arising from use of the platform. Our aggregate liability is limited to fees paid in the twelve months preceding the claim, or one hundred US dollars during free access periods.

Changes

We may update these Terms. Material changes will be communicated through the platform or email. Continued use after changes constitutes acceptance.
